Terms and Conditions Clause: Attendee Cancellations, Refunds and Credits.
Terms
- 'event' - refers to any training, summit, workshop or event run or hosted by AI Surge Pty Ltd.
1. Minimum Participant Numbers and Workshop Format

1.1. Minimum Delegates: Please note that our events require a minimum number of registered delegates to proceed in their advertised physical format.AI Surge Pty Ltd reserves the right to make a determination regarding participant numbers 7 days prior to the event.

1.2. Alternative Format: Should the minimum number of registered participants not be met by this time, AI Surge Pty Ltd may, at its discretion, transition the event to an alternative format. This alternative format (which may include, but is not limited to, an online or hybrid delivery model) will be designed to ensure that all registered participants can access the full workshop content.

1.3. Maintain Outcomes: In such an event, our commitment is to maintain, as far as reasonably practicable, the intended learning outcomes, quality, and interactive nature of the event. Registered participants will be notified in writing of any such change in delivery format. By registering for an event, you acknowledge and agree to this potential modification of the delivery format.

2. Attendee Cancellations
We understand that circumstances can change. If you, as a registered attendee, are unable to attend your event, the following conditions will apply to your registration:

2.1. Notification: All cancellations must be made in writing and sent to hello@aisurge.com.a
u. The date of cancellation will be the date this written notification is received by AI Surge Pty Ltd. -
2.2. Refund and Credit Policy for Attendee-Initiated Cancellations:
- (a) Cancellations within 30 days of an event: No refunds or credits will be issued for cancellations received within 30 days of an event start date. This policy is in place due to advance commitments and costs incurred by AI Surge, including but not limited to venue, catering, speaker, travel and logistical arrangements.
- (b) Cancellations prior to 30 days of the Conference: For cancellations received in writing more than 30 days before the event start date, a partial refund of 50% of the registration fee may be granted. All such refunds will be subject to an additional administration fee of $25.
- (c) Failure to Attend (No-Show): No refunds or credits will be granted for attendees who do not attend an event and have not provided prior written notification of cancellation according to the terms above.

2.3. Credit or Voucher Option:
- At the sole discretion of AI Surge Pty Lt
d, and particularly in cases where a cash refund is not applicable under section 1.2, we may offer a credit voucher. This credit voucher, if offered, would typically be for a portion of the registration fee and valid for use towards a future event. The terms and validity period of any such credit voucher will be determined during the request.

2.4. Ticket Transfers:
- Attendees may transfer their registration to another person from their organisation or another suitable individual at any time up to 7 days prior to the event start date.
- Requests for ticket transfers must be made in writing to hello@aisurge.com.au, and must include the full name, job title, organisation, and contact details (email and phone) of the substitute delegate.
- No administration fee will be charged for compliant ticket transfers. Transfers requested less than
7days prior to the event may be considered at our discretion and may be subject to a late administration fee of $25 per registration. AI Surge Pty Lt reserves the right to refuse a transfer if the proposed substitute delegate is not deemed suitable for the event.
- 2.5. General:
- Any refunds issued will be processed after the event has been held.
- AI Surge Pty Ltd is not responsible for any travel, accommodation, or other costs incurred by attendees in relation to their registration or cancellation.
- 3.1. Scope
- Certain AI Surge programmes may include multiple components delivered across different locations and formats, including (but not limited to) offshore or international components such as conferences, study tours, school visits, or partner events.
- 3.2. International Arrangements
- While every effort will be made to deliver all advertised programme components, international and offshore activities are subject to external factors outside AI Surge Pty Ltd’s control, including but not limited to airline schedules, visa requirements, border restrictions, health and safety advisories, and minimum participant numbers.
- 3.3. Programme Modification or Substitution
- If an offshore or international component cannot proceed as scheduled due to circumstances beyond AI Surge Pty Ltd’s reasonable control, the company reserves the right to modify, postpone, relocate, or replace that component with an alternative onshore or online learning experience of comparable professional value.
- AI Surge Pty Ltd will communicate any such changes in writing and will make reasonable efforts to maintain the intended learning outcomes of the overall programme.
- 3.4. Participant Responsibilities
- Participants are responsible for:
- Obtaining and maintaining valid travel documentation (including passports and visas);
- Complying with all entry, vaccination, and travel requirements for the destination country;
- Arranging and maintaining comprehensive travel and medical insurance covering cancellation, delay, and personal risk;
- Covering all personal expenses related to travel, accommodation, and incidental costs unless expressly included in the registration fee.
- Participants are responsible for:
- 3.5. Cancellations by Participants
- For programmes that include an offshore or international component, the following apply in addition to Clause 2:
- Cancellations received within 30 days of the advertised departure or start date of the offshore component are non-refundable.
- Cancellations received more than 30 days prior to the departure or start date may be eligible for a 50% refund of the registration fee for that component, less a $100 administration fee, provided that no non-refundable international bookings have been made by AI Surge Pty Ltd on behalf of the participant.
- In cases where non-refundable costs (such as conference tickets, venue deposits, or group travel bookings) have been committed prior to cancellation, those costs will be deducted from any refund due.
- 3.6. Cancellations by AI Surge Pty Ltd
- If AI Surge Pty Ltd cancels an offshore or international component, participants will be offered either:
- A partial refund reflecting the value of the cancelled component; or
- A credit of equivalent value toward a future AI Surge programme.
- AI Surge Pty Ltd shall not be liable for any participant-incurred costs including travel, accommodation, or other personal expenses.
- 3.7. Force Majeure
- AI Surge Pty Ltd will not be liable for any delay, alteration, or cancellation resulting from events beyond its reasonable control, including but not limited to natural disasters, government actions, strikes, epidemics, pandemics, or transport disruptions.
